When lower courts cite cert-denial writings, most rely on them as support
PARTIAL Reliance provisional S4, verified with fixes, Nov 4, 2026
Claim
In a random sample of 120 lower-court cases from 2016 to 2025 that cite a Supreme Court writing respecting the denial of certiorari, between 0.575 (95% CI 0.486 to 0.660) and 0.642 (95% CI 0.553 to 0.722) rely on the writing as support, and between 0.233 (95% CI 0.167 to 0.317) and 0.267 (95% CI 0.196 to 0.352) use it as the sole cited authority without flagging it as non-binding. The range depends on whether a citation noting that the law is unsettled is coded as support or as a signal. These H3 numbers are PROVISIONAL: two-coder agreement, kappa 0.768 [0.603, 0.900], has a lower bound touching the preregistered 0.60 bar.
Two exploratory readings come with it. Citation rates in the federal courts of appeals rose from 6.00 to 23.13 per 10,000 cases between 2006 to 2015 and 2016 to 2025 (rate ratio 3.85 [3.22, 4.63], EXPLORATORY because the detector failed its own audit). Justices Thomas and Sotomayor account for 0.464 [0.435, 0.493] of 2016 to 2025 citing (case, Justice) pairs, below the preregistered 0.50 (EXPLORATORY).

- Data
- CourtListener bulk data dated Sept. 30, 2026 (opinions, opinion clusters, dockets, courts), streamed Nov 4, 2026. Every lower-court opinion text was scanned; denominators are deduplicated cases per court-year in the same snapshot.

- A round-2 verifier, run in a separate agent context of the same model family, reran the pipeline byte for byte, recomputed H1 and H2 exactly and returned PARTIAL; its wording fixes are applied and no results number changed. A second coder, also a separate agent context of the same model family, coded a 60-case random subsample from a label-free packet whose codebook is the preregistered text verbatim. A round-3 re-check of those edits, again a separate agent context of the same model family, returned REPRODUCED with wording-only fixes. Every stage ran in agent contexts of the same model family; outside replication is welcome.

COMPUTED means this study's code on the pinned data. REPORTED is taken from the cited source. REPORTED-VERIFIER was computed by the verifier, a separate agent context of the same model family. POST-HOC and EXPLORATORY were not preregistered as tests.

preregistered
Method
- Preregistration frozen by sha256 before outcomes; deviations D1 to D23 disclosed.
- A frozen rule-based detector scans every opinion's text for references to writings respecting the denial of certiorari and classifies each mention as a substantive citation, a subsequent-history notation or a non-citation, with the authoring Justice.
- Mentions are deduplicated to cases and scaled per 10,000 deduplicated cases in the same snapshot.
- The detector was measured on a stratified audit. It failed the preregistered gate, so H1 and H2 were demoted to EXPLORATORY.
- A random 120-case sample of 2016 to 2025 citing cases was hand-coded with the preregistered codebook (RELIED, SIGNAL, DESCRIBED, NOTATION, plus sole-authority and flagged-non-binding flags), each code with a verbatim quote. Coder A is the author context; coder C, a separate agent context of the same model family, coded a 60-case random subsample.
- Tests per the preregistration: exact conditional binomial for H1, cluster bootstrap for H2, Wilson intervals for H3, Holm correction across four tests. A deterministic rerun re-created 16 files byte for byte.
limits
Limits
- The detector failed its audit: about 1 in 5 mentions it rejects is a real citation, mostly citations that never name the Justice. All counts are lower bounds.
- Recall (0.893 for substantive citations) is measured only inside the "denial of certiorari" phrase net. A citation without that phrase is neither counted nor measured.
- CourtListener's federal appellate case volume fell by a third between the periods, which drives part of the rate increase (count ratio 2.57 vs rate ratio 3.85).
- Agreement: the kappa lower bound is seed-sensitive and falls to 0.527 when identical texts are resampled together, so the preregistered 0.60 gate is not passed. Six of seven disagreements are coder A RELIED against coder C SIGNAL, mostly citations used to show the law is unsettled.
- An earlier second-coder run (coder B) used a packet codebook that did not match the locked text; it is superseded and kept on disk.
- 38 near-identical D. Kan. orders on one day count as 38 cases under the preregistered rule; collapsing them gives 0.620 RELIED.
- RELIED counts use in any opinion text in the case; most texts are combined opinions, so majority use cannot be separated from separate writings.
- Coders, verifiers and the author all ran in agent contexts of the same model family on one box.
falsifiers
What would change the verdict
- A codebook adjudication and a human re-code on the preregistered text put the RELIED-vs-not kappa lower bound clearly below 0.60, or the RELIED share's upper bound below 0.25.
- A recount with a detector that passes the audit gives a federal appellate rate ratio whose interval includes 1.5.
- A Westlaw or Lexis citing-references pull for the most-cited writings shows a flat 2006 to 2025 trend.
